3.2. To submit a legally valid notice under Article 16 DSA, please send an electronic mail message to abuse@wpineu.com with the subject line "DSA Article 16 Notice" containing the four mandatory statutory elements detailed below:
| Mandatory Article 16 Element | Required Information in Your Report to abuse@wpineu.com |
|---|---|

| 2. Exact Electronic Location | The exact URL or URLs where the allegedly illegal content is located (generic domain names without specific paths are insufficient where only specific pages are alleged to be unlawful). |
| 3. Reporter Identification | The full name and electronic mail address of the individual or entity submitting the notice (except where statutory criminal law exceptions under Article 16(3)(c) DSA permit anonymous reporting). |
| 4. Good-Faith Declaration | Include the verbatim statement:"The reporting party hereby confirms its bona fide belief that the information and allegations contained in this notice are accurate and complete." |
3.3. Upon receipt of a complete notice, WPinEU will promptly send an electronic acknowledgment of receipt to the reporter, review the notice in a timely, diligent, non-arbitrary, and objective manner through human assessment, and notify the reporter of its decision along with information on available redress mechanisms.
4. Content Moderation Policies, Automated Tools, and Statements of Reasons (Articles 14 & 17 DSA)
4.1. No General Monitoring Obligation (Article 8 DSA): WPinEU does not proactively monitor or censor the editorial content uploaded by users to their WordPress websites or databases.
4.2. Automated Security Tools (Article 14 DSA): To preserve server integrity and protect the European network environment, WPinEU deploys ImunifyAV for automated signature-based detection of malware, phishing scripts, and security exploits across hosted files, alongside network-level DDoS mitigation and CloudLinux resource isolation. Automated detection of active malware or phishing kits may result in the quarantine of the specific malicious file.
4.3. Statement of Reasons and Redress (Articles 17, 20 & 21 DSA): Whenever WPinEU removes specific hosted content, disables access to a URL, or suspends/terminates a hosting account due to illegal content or incompatibility with the Terms of Service, WPinEU will provide the affected user with a clear and specific Statement of Reasons under Article 17 DSA. Affected users have the right to contest the decision via WPinEU's internal complaint review process (support@wpineu.com), seek out-of-court dispute settlement before a body certified by HAKOM under Article 21 DSA, or pursue judicial redress before the competent courts of the Republic of Croatia.
5. Transparency Reporting (Article 15 DSA)
5.1. As a small/micro-scale educational hosting initiative within the meaning of Commission Recommendation 2003/361/EC, WPinEU qualifies for the micro and small enterprise exemption from annual public transparency reporting under Article 15(2) of the DSA, while maintaining internal statutory records for inspection by the Digital Services Coordinator (HAKOM) upon request.
