Terms of Service & Acceptable Use Policy
Welcome to WP in EU (WPinEU.com). These Terms of Service and Acceptable Use Policy ("Terms") govern your access to and use of WPinEU's free European web hosting infrastructure, cPanel control panel, MySQL databases, email services, and network subdomains.
Section A: Automatic Incorporation of the GDPR Article 28 Data Processing Agreement (DPA)
1. Incorporation by Reference: To the extent that the Customer uses the WPinEU hosting environment (including cPanel, WordPress, MySQL databases, electronic mail accounts, and subdomains under wpat.eu or addon domains) to store or process Personal Data subject to Regulation (EU) 2016/679 (GDPR), the Customer acts as the Data Controller and WPinEU acts as the Data Processor.
2. Binding Effect: By creating a WPinEU hosting account or accepting these Terms of Service, the Customer and WPinEU automatically enter into the WPinEU Data Processing Agreement (DPA) published at https://www.wpineu.com/dpa, which is incorporated into these Terms of Service by reference as if fully set forth herein.
Section B: European Union Residency Eligibility & Verification
1. EU Residency Requirement: WPinEU's free hosting tier (1 GB NVMe SSD storage, 100 GB monthly bandwidth, 2 addon domains, 2 MySQL databases, 2 email accounts, cPanel, and LiteSpeed) is provided exclusively to residents and established entities of the European Union / European Economic Area (EU/EEA).
2. Non-Invasive Verification: WPinEU verifies eligibility at registration using non-invasive network and account indicators in accordance with our Privacy Policy. Accounts registered via anonymized proxies, VPNs masking non-EU residency, or fraudulent identity details may be declined or suspended.
Section C: Acceptable Use Policy (AUP) & wpat.eu Subdomain Rules
Customers may use WPinEU infrastructure for learning web development, personal blogs, portfolios, educational projects, and legitimate small business or e-commerce websites. The following activities are strictly prohibited across all hosted domains, wpat.eu subdomains, databases, and email accounts:
- Phishing, Malware & Exploits: Hosting phishing kits, deceptive credential-harvesting pages, malware distribution, command-and-control (C2) scripts, web shells, or network scanners.
- Unsolicited Bulk Email (Spam): Sending bulk commercial email, operating open mail relays, or using the 2 included cPanel email accounts for mass mailing lists.
- Illegal Content under EU or Croatian Law: Uploading, storing, or disseminating any content that violates European Union law or the laws of the Republic of Croatia, including copyright/trademark infringement, child sexual abuse material (CSAM), terrorism-related content, defamation, or unlawful hate speech.
- Resource Abuse & Crypto Mining: Operating cryptocurrency miners, open proxies, VPN endpoints, BitTorrent trackers/seedboxes, file-sharing mirrors, or scripts designed to bypass CloudLinux Lightweight Virtual Environment (LVE) CPU, RAM, or I/O fairness limits.
Section D: Content Moderation, Automated Security Scanning, and DSA Redress (Article 14 DSA)
1. Automated Malware Protection (ImunifyAV): WPinEU utilizes automated security tools—specifically ImunifyAV, CloudLinux, and network-level DDoS mitigation—to preserve server stability and network security. Files matching known malware or phishing signatures are automatically quarantined.
2. Human Review & Notice-and-Action: Reports of illegal content or AUP violations submitted via abuse@wpineu.com pursuant to our DSA Compliance Policy (/dsa) are evaluated through human review.
3. Statement of Reasons & Appeals (Articles 17, 20 & 21 DSA): In the event that WPinEU restricts access to specific hosted content or suspends/terminates an account for illegal content or violation of these Terms, WPinEU will issue a Statement of Reasons to the Customer's registered email address. The Customer may appeal the decision via support@wpineu.com, pursue out-of-court dispute resolution before a body certified by the Croatian Digital Services Coordinator (HAKOM), or seek judicial redress before the competent courts in Zagreb, Croatia.
1. Acceptance of Terms
By creating an account, accessing cPanel, or using any WPinEU hosting service, you agree to be bound by these Terms of Service and all incorporated documents (including the DPA and Privacy Policy). If you do not agree, you must discontinue use immediately.
2. Service Description & Educational Mission
WPinEU provides high-performance, ad-free web hosting infrastructure to empower European developers, students, freelancers, and organizations to build modern websites without cost barriers.
3. Account Responsibilities & Credentials
You are solely responsible for:
- Maintaining strong passwords and safeguarding your cPanel, Client Area, and WordPress administrative credentials.
- All activities and data transmissions conducted under your account.
- Keeping third-party WordPress core software, plugins, and themes patched and updated against known security vulnerabilities.
- Ensuring your contact email in the Client Area remains active and monitored for administrative or security notifications.
4. Resource Allocation & Fair Use Limits
Each standard free hosting account is provisioned with:
- Storage: 1 GB high-speed NVMe SSD storage in RAID 10 configuration.
- Bandwidth: 100 GB monthly bandwidth allowance.
- Domains & Databases: 2 addon domains, 2 MySQL databases, and 2 email accounts.
- Platform: cPanel control panel with Softaculous 150+ one-click installers and LiteSpeed web serving.
5. Data Protection, Backups, and EU Sovereignty
All servers and storage arrays are located strictly within European Union data centers. While WPinEU generates daily automated JetBackup snapshots for infrastructure disaster recovery, Customers remain responsible for maintaining independent off-site backups of critical databases and files via the cPanel Backup Wizard.
6. Account Inactivity & Termination
To maintain server resource availability for active educational and community projects, accounts that experience complete inactivity (no web traffic and no user authentication logins) for an extended period of 30 consecutive days may be subject to automated notification and subsequent deactivation. Account holders may export their data or request renewal at any time prior to scheduled purging.
7. Service Availability & Maintenance
WPinEU strives to maintain a 99.9% uptime target across hosting nodes as detailed in our Service Level Agreement (SLA). Planned maintenance windows are scheduled during off-peak European hours whenever practical.
8. Limitation of Liability & Disclaimers
WPinEU hosting services are provided on an "AS IS" and "AS AVAILABLE" basis for educational, developmental, and community web hosting. To the maximum extent permitted by applicable law, WPinEU disclaims all warranties of any kind and shall not be liable for indirect, incidental, or consequential damages arising from service interruptions or data loss.
9. Modifications to Terms
WPinEU reserves the right to modify these Terms to reflect technical updates, infrastructure changes, or regulatory requirements. Material updates will be communicated through the Client Area or registered email addresses at least 14 days in advance.
